These Terms of Service ("Terms") govern your access to and use of the Vorld mobile application, website, and all related services (collectively, the "Services"), operated by Vorld AG, a company registered under the laws of Switzerland ("Vorld," "we," "us," or "our").

By accessing, downloading, registering for, or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

These Terms incorporate by reference our Privacy Policy, Community Guidelines, and any additional terms presented for specific features, promotions, or paid services.

1. Eligibility

You may use the Services only if you are legally capable of entering into a binding contract under applicable law.

1.1 Minimum Age

The Services are not directed to children under 13. No person under 13 may create an account or use the Services. If you are at least 13 years old but under the age of majority in your jurisdiction, you may use the Services only with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

1.2 Authority

If you use the Services on behalf of a company, club, or other legal entity, you represent and warrant that you are authorised to bind that entity to these Terms, and "you" will refer to both you and that entity.

We may refuse access to, suspend, or terminate accounts that do not satisfy these eligibility requirements.

2. Accounts and Registration

To access certain features, you must create an account. You agree to:

  • provide accurate, current, and complete registration information;
  • keep your information updated;
  • maintain the security and confidentiality of your login credentials;
  • accept responsibility for all activity that occurs under your account; and
  • notify us promptly at [[email protected]] of any unauthorised use of your account.

2.1 Account Restrictions

You may not create more than one personal account without our written permission, sell, transfer, or share your account, or impersonate any person or entity.

2.2 Authentication Methods

Accounts may be created using email/password or third-party providers (e.g. Google, Apple). If you register through a third-party service, you authorise us to receive certain information from those providers consistent with your settings and their terms.

2.3 Account Actions

We may, in our sole discretion, suspend or terminate your account if we believe you have violated these Terms or that your use of the Services creates risk for Vorld, other users, or third parties.

3. Description of the Services

Vorld is a digital platform that enables users to:

  • track lap times on designated pumptracks using a proprietary, device-based algorithm;
  • view rankings based on categories such as gender, age, and vehicle type;
  • create and interact with content (posts, images, comments);
  • follow other users and engage socially; and
  • participate in Events and Challenges (current or future functionality).

3.1 Nature of the Services

The Services are provided as a tool for tracking and comparison purposes only. We do not guarantee accuracy of results, continuous availability, or official competition validation. Vorld is not the organiser, operator, referee, or safety supervisor of any physical event or pumptrack.

4. Lap Tracking and Rankings

4.1 Algorithm-Based Validation

Lap tracking is performed using a proprietary algorithm operating on the user's device and validated via backend systems. The algorithm is confidential and not disclosed to users. Validation includes automated review of session data, including motion data recorded during sessions (e.g. CSV files of device movement data).

4.2 No Guarantee of Accuracy

We do not guarantee that laps will always be detected correctly, that times are accurate or complete, or that rankings reflect real-world performance perfectly. Timing outputs may depend on device sensors, network conditions, GPS accuracy, and other factors outside Vorld's control.

4.3 Final Authority

We reserve the right, at our sole discretion, to validate or invalidate laps, modify or remove session data, adjust rankings, and investigate suspicious activity. All decisions regarding lap validity and rankings are final.

4.4 Fair Use

Users must not attempt to manipulate lap tracking, exploit system weaknesses, or falsify performance data. Violations may result in removal of data, account suspension, or permanent ban.

5. User Content and Social Features

5.1 User-Generated Content

Users may upload and share content, including photos, posts, comments, and lap and performance data ("User Content"). You retain whatever ownership rights you have in your User Content.

5.2 License to Vorld

By uploading content, you grant Vorld a worldwide, non-exclusive, royalty-free, sublicensable, transferable licence to host, store, reproduce, distribute, modify, adapt, create derivative works from, publicly display, and otherwise use your User Content in connection with operating, improving, and promoting the Services. This licence ends within a commercially reasonable period after you delete your User Content or your account, except where retention is required for legal compliance, dispute resolution, fraud prevention, or where content has been shared with others.

5.3 Public and Private Profiles

By default, profiles are public. Users may choose to make their profile private, in which case lap history is restricted to approved followers. Certain data such as aggregated ranking positions may remain visible regardless of privacy settings. We do not guarantee full anonymity in rankings.

5.4 Content Responsibility

You are solely responsible for content you upload. You represent and warrant that you own or control all rights necessary, that your content does not infringe any third-party rights, and that your content does not violate any applicable law or these Terms.

5.5 Moderation and Removal

We reserve the right, at our sole discretion, to remove any content, restrict visibility, or suspend or ban users, without prior notice or explanation. Users may report content; we are not obligated to act on reports but may review them at our discretion.

6. Events and Challenges

6.1 Nature of Events

Events and Challenges are features that allow users, organisers, or third parties to create competitions, track performance within a defined context, and potentially offer prizes or sponsorships.

6.2 Role of Vorld

Vorld acts solely as a platform provider. We do not organise or operate pumptracks, do not control physical events, and do not guarantee event execution, safety, or legality.

6.3 Organiser Responsibility

Event organisers are solely responsible for obtaining all permissions from pumptrack owners, municipalities, or authorities, complying with local laws and regulations, managing participants and logistics, and ensuring the legal sufficiency of any participant waiver.

6.4 Prizes and Sponsorships

Events may include prizes or sponsorships. Vorld is not responsible for delivery of prizes, sponsor obligations, or disputes between participants and organisers.

6.5 Fees and Payments (Future)

Event participation may require payment in the future. Vorld may charge fees or commissions for event-related services. Vorld does not act as a payment intermediary or custodian of funds between users.

7. Acceptable Use

You agree not to, and not to assist or permit others to:

  • misuse the Services or use them for any unlawful, fraudulent, or harmful purpose;
  • attempt to manipulate rankings, lap tracking, or system integrity;
  • harass, threaten, intimidate, or abuse any person;
  • post content that is defamatory, obscene, hateful, discriminatory, or violent;
  • upload malware, viruses, or malicious code;
  • access the Services through unauthorised automated means (bots, scrapers, crawlers);
  • reverse engineer, decompile, or extract source code except where permitted by mandatory law;
  • collect or harvest user data without authorisation; or
  • use the Services to build a competing product or service.

We reserve the right to monitor the Services, investigate violations, and take any action we deem appropriate, including removal of content, suspension, termination, or referral to law enforcement.

8. Safety and Disclaimer of Physical Activity

8.1 Use at Your Own Risk

The Services relate to physical activities (e.g. riding pumptracks). You acknowledge that such activities carry inherent risks, including collision, falls, equipment failure, physical exertion, serious injury, and death. Participation is entirely at your own risk.

8.2 No Responsibility for Incidents

Vorld is not responsible for injuries, accidents, damages, or losses occurring during use of pumptracks or participation in events. We do not supervise users, verify safety conditions of locations, or provide safety guarantees.

9. Payments and Paid Features

9.1 Free Service (Current State)

The Services are currently provided free of charge.

9.2 Future Paid Features

Vorld may introduce subscriptions, paid features, event participation fees, or organiser tools. All pricing will be clearly communicated within the Services before purchase.

9.3 Automatic Renewal

Unless otherwise disclosed, subscriptions automatically renew for successive periods unless cancelled before the renewal date. Cancellation takes effect at the end of the current billing period. Except where required by law, fees already paid are non-refundable.

9.4 App Store Purchases

If you purchase through the Apple App Store or Google Play, your purchase may be subject to the applicable store's billing terms and subscription management rules.

10. Intellectual Property

All rights, title, and interest in and to the Services, including software, algorithms, design, trademarks, branding, and content provided by Vorld, are and remain the exclusive property of Vorld AG. Subject to your compliance with these Terms, Vorld grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use the Services for your personal, non-commercial use.

You may not copy, modify, distribute, publicly display, sell, licence, or create derivative works from the Services without prior written consent. All rights not expressly granted are reserved.

11. Feedback

If you provide comments, ideas, suggestions, or other feedback regarding the Services ("Feedback"), you grant Vorld a perpetual, irrevocable, worldwide, royalty-free, transferable, sublicensable right to use that Feedback for any lawful purpose, without compensation or attribution.

12. Copyright Complaints

Vorld respects intellectual property rights. If you believe content on the Services infringes your copyright, you may send a notice to our designated agent containing:

  1. your signature;
  2. identification of the copyrighted work;
  3. identification and location of the allegedly infringing material;
  4. your contact information;
  5. a good-faith belief statement; and
  6. a statement of accuracy under penalty of perjury.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. VORLD DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

VORLD DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT CONTENT WILL BE ACCURATE, COMPLETE, OR CURRENT, OR THAT DEFECTS WILL BE CORRECTED.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VORLD AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VORLD'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) ONE HUNDRED SWISS FRANCS (CHF 100); OR (B) THE AMOUNT YOU PAID TO VORLD IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including under Swiss mandatory law.

15. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Vorld and its affiliates, officers, directors, employees, and agents from and against any claims, actions, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

  • your use of the Services;
  • your User Content;
  • your violation of these Terms or applicable law;
  • your infringement of any third-party rights; or
  • your participation in any event or physical activity in connection with the Services.

16. Dispute Resolution and Governing Law

16.1 Informal Resolution

Before filing a claim, you and Vorld agree to try in good faith to resolve any dispute informally. You must send written notice to [[email protected]], including your name, account email, a description of the dispute, and the relief requested. If we cannot resolve the dispute within 60 days, either party may proceed as permitted below.

16.2 Governing Law

These Terms are governed by the substantive laws of Switzerland, without regard to conflict-of-laws principles.

16.3 Jurisdiction

The exclusive place of jurisdiction is the registered seat of Vorld AG in Switzerland, unless otherwise required by mandatory applicable law (including mandatory consumer protection provisions in the EU/EEA that grant jurisdiction at the consumer's place of domicile).

16.4 EU/EEA Consumer Rights

If you are a consumer habitually resident in the EU/EEA, you benefit from any mandatory provisions of the law of your country of residence. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions. You may also bring proceedings before the courts of your country of residence.

16.5 US Arbitration (US Users Only)

If you are located in the United States, you and Vorld agree that any dispute arising out of or relating to these Terms or the Services shall be resolved by binding individual arbitration administered by JAMS under its applicable consumer arbitration rules, except for claims that qualify for small claims court or claims involving intellectual property. YOU AND VORLD AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. YOU WAIVE ANY RIGHT TO A JURY TRIAL.

16.6 Opt-Out Right (US Users)

You may opt out of the arbitration agreement by sending written notice to [[email protected]] within 30 days after first accepting these Terms, including your full name, account email, and a clear opt-out statement.

16.7 Time Limit

To the extent permitted by law, any claim arising out of or relating to the Services or these Terms must be filed within one (1) year after the claim arose, or the claim will be permanently barred.

17. Termination

17.1 Termination by User

You may delete your account at any time through the Services or by contacting support. Upon deletion, your data is removed from active systems, content associated with your account is deleted, and lap data is removed from rankings.

17.2 Termination by Vorld

We may suspend, restrict, or terminate your access to all or part of the Services at any time, with or without notice, for violation of these Terms, suspected abuse or manipulation, legal or regulatory requirements, or to protect users or third parties.

17.3 Data Retention After Termination

Certain limited data (e.g. email address) may be retained where legally required or necessary for fraud prevention. Upon termination, provisions that by their nature should survive will survive, including ownership, licences, disclaimers, limitations of liability, indemnification, and dispute resolution.

18. Changes to the Services and Terms

We may modify, suspend, or discontinue any part of the Services at any time. We may update these Terms from time to time. If we make material changes, we will provide notice by reasonable means, such as posting updated Terms, updating the effective date, or providing in-app notice. Your continued use of the Services after the effective date constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Services.

19. App Store Terms

If you access the Services through an iOS application, you acknowledge that these Terms are between you and Vorld, not Apple; that Apple has no obligation to furnish maintenance or support; and that Apple and its subsidiaries are third-party beneficiaries of these Terms. Comparable provisions apply for Google Play.

20. General Provisions

These Terms constitute the entire agreement between you and Vorld regarding the Services. If any provision is held invalid or unenforceable, that provision will be limited to the minimum extent necessary, and the remaining provisions will remain in full force. Vorld's failure to enforce any provision will not operate as a waiver. You may not assign these Terms without our consent; we may assign them freely. Notices to you may be provided by email, in-app notice, or other reasonable means. Section headings are for convenience only.
